Wrongful Death
Wrongful death is a legal term used to describe an event in which a negligent act caused a person to lose their life. I have always thought the term was slightly confusing in that I can imagine very few instances when a death would be “Right”. Whether the loss was caused by a car accident, the negligent manufacturing of a product, improper property maintenance, negligent entrustment of a piece of property, or one of a host of other unsafe acts the loss of a loved one is devastating to a family.
When it comes to making a claim against an individual or corporation for the death there are many special legal considers. For example who does have a right to make a claim, a shortened statute of limitation, calculation of the extraordinary loss, and damages.
